一趟被取消的列车并不取消你的车票。它为你打开三个可选的选项、等待期间的照管,以及在你晚到超过 2 小时时票价的 50%。

布拉格到柏林,两个欧盟国家之间的国际旅程,车票 3 周前以 58 欧元买下。预定发车下午 1:32,预定到达下午 5:50。

下午 1:20,你那趟列车的那一行翻成“已取消”。公司的员工从早上开始罢工。没有任何广播说接下来会怎样。

列车不会开了。你拿你的车票怎么办?

答对 · 我去柜台,要求条例给我的那个选择:退款,或者尽早改乘,或者在我方便的日期改乘。

取消打开三个选项,而挑选的是你 条例不让公司单方面决定。一旦取消在到达时造成 60 分钟或以上的损失,公司就必须立即提供三个选项之间的选择,并作出相应的安排。这不是一次善意表示:这是一项义务,而它的动词是“shall immediately offer”。

误区 · 列车车票是有日期的:取消就意味着作废。我买一张明天的新票。

误区 · 取消不是延误:没有延误,就没有什么可索赔的。

误区:“得有延误才行,可列车已经没有了” 这一条没有作这样的区分。它在同一句话里、同一层次上点名三种情形:出发延误、错过衔接和取消。触发你权利的不是信息屏上显示的状态,而是可预见的到达延误,60 分钟或以上。

答对 · 我拒绝代金券,要求以货币退款,或者要求尽早改乘。

只有在你接受时,代金券才能替代退款 条文允许代金券,但附一个条件,而这个条件就是你。退款只有在代金券的条件足够灵活,并且旅客同意接受时,才可以采取代金券的形式。只要你什么都没有签,以货币退款就仍然摆在桌上。赔偿也是同一个道理:条例规定,经旅客请求,赔偿以货币支付。

“The reimbursements referred to in point (a) of paragraph 1 and in paragraph 3 shall be paid within 30 days after the receipt of the request. […] The reimbursement may take the form of vouchers and/or the provision of other services provided that the terms of those vouchers and/or services are sufficiently flexible, in particular regarding the validity period and destination, and that the passenger agrees to accept those vouchers and/or services. The reimbursement of the ticket price shall not be reduced by financial transaction costs such as fees, telephone costs or stamps.”

误区 · 我拿代金券:现在就到手的 20 欧元,怎么都胜过一场索赔。

100 分钟没有任何方案。这让你有权做什么?

你可以索赔多少,按什么计算基础?

答对 · 票价的 50%,也就是 29 欧元,因为到达延误超过 2 小时。

铁路的标尺是一个百分比,距离在其中不起作用 这里与航空完全不同:没有距离区段,没有定额。条例定下的是票价的一个百分比,而且只有两级。延误 60 到 119 分钟之间 25%,自 120 分钟起 50%。它还加了一个价值千金的细节:这项赔偿是应付的,而你不会因此丧失运输权利。

“Without losing the right of transport, a passenger is entitled to compensation for delays from the railway undertaking if he or she is facing a delay between the places of departure and final destination stated in the ticket or through-ticket for which the cost has not been reimbursed in accordance with Article 18. 误区 · 既然我是坐长途客车走完的,那计算基础就是长途客车的票价。

误区:“按你最后付了什么来计算” 条文只指定一个基础,别无其他:为被延误的那项服务实际支付的全价。那项服务是被取消的列车,不是顶替它的长途客车。长途客车车票走另一条路,也就是改乘费用报销那条路。两项请求,两个基础,同一封信。

误区:“公司之后什么都没有了” 官方页面给出上面那一层,连它的期限一起。一份不令你满意的答复打开 3 个月,让你去找本国机构,而它还点名是哪一个:颁发该公司许可的那个机构。该机构须在 3 个月内处理,复杂案件 6 个月,并就如何推进出具一份法律意见。

“If you did get a reply from the railway company but were not satisfied, you can also complain to the relevant national authority in your country within 3 months of the rejection of your complaint by the railway company. You should address your complaint to the national authority that granted the railway company's licence. The national authority's complaint-handling procedure should take a maximum of 3 months (or six months for complex cases). The national authority should provide you with a non-binding legal opinion on how to proceed with your claim.”
