启动时的一个弹窗、唯一一个按钮、第 31 页上一个已经替你勾好的方框。条例用五个词定义了你的同意,而这个弹窗一个都不满足;要证明你给过同意,得由他们来做,绝不是由你来证明你没给过。

你用了 3 年的跑步应用打开时,出现的不是你周日的路线:一整屏、一片让人安心的蓝色背景、一个真正能按的按钮。

一个按钮、一行小字、47 页在别处。什么才算有效的同意?

答对 · 我不把任何东西当成已被接受:同意要通过明确的肯定性行为给出,不是靠继续跑步给出。

同意是有定义的,而这个定义就在五个词里 条例没有把这个词交给通用条款的起草者:它自己给出定义。自由作出的、具体的、知情的、不含歧义的意愿表示,通过一项声明或者一项明确的肯定性行为作出。继续使用一个应用,既不是一项声明,也不是一项毫无歧义地说出“我同意那项处理”的行为:那只是你去跑了一趟步。

“‘consent' of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;”

非官方译文:你的同意必须是自由给出的、为了一个确切的目的、在知道自己接受什么的情况下给出、不含歧义,并且通过一个说“是”的动作给出。这份清单上的每一个词都是一个条件。

误区 · “继续浏览即表示你接受”:到处都这么写,那就一定有效。

误区:“继续就是同意” 欧盟官方页面描述了它所期待的动作,而那不是这一个:明确地表示你的同意,例如签署一份同意书,或者在一项清楚的请求下选择“是”。一句把你对服务的正常使用换算成同意的话,并不产生同意:它是在试图不去取得同意。

“When a company or organisation asks for your consent, you have to make a clear action agreeing to this, for example by signing a consent form or selecting 'yes' from a clear yes/no option on a webpage.”

没有作用 · 我点“以后再说”,而且我打算每天早上都这么点,点到世界尽头。

每天躲一次不是一种法律身份 你可以一直把窗口推开,但在你点的时候,看看它没有给你什么:在你表示任何同意之前,别人应当告知你你的数据将被用于什么、会被保存多久、谁会收到它们,以及你有哪些权利。一个只提供一个按钮和一片让人安心的蓝色背景的窗口,满足不了这份清单,而这一处缺失是可以记录下来的。

一个预先勾好的方框,埋在第 31 页。它值多少?

答对 · 我取消勾选,并回复说:同意请求必须与文件的其余部分明显可区分。

同意不能夹在两个条款之间塞进来 当同意是在一份同时处理其他事项的文件里被请求时,条例加了一道形式要求:请求必须与其他事项明显可区分、易懂、易于获取,并且使用简明易懂的语言。它还加上了拆掉这一整套组合的那句话:该文件中违反条例的任何部分不具约束力。

“2. If the data subject's consent is given in the context of a written declaration which also concerns other matters, the request for consent shall be presented in a manner which is clearly distinguishable from the other matters, in an intelligible and easily accessible form, using clear and plain language. Any part of such a declaration which constitutes an infringement of this Regulation shall not be binding.”

误区 · 方框是勾着的,但我本可以取消勾选:所以那是一次真正的选择,所以它成立。

误区:“能说不就等于说过是” 欧盟官方页面正是用这个例子说了相反的话:能够选择退出并不够,你必须明确地选择加入。预先勾好的方框把动作的负担反了过来:为了拒绝你才要动手,而法律要求的是为了接受才动手。

误区 · 它写在我注册时确认过的条款里:签了就是签了。

误区:“写在合同里,所以就成立” 规范同意形式的那一款以很少有人读的一句话结尾:此类声明中构成违反条例的任何部分不具约束力。一份 47 页的文件不会给一项形式不合格的同意请求装上装甲:它把请求埋起来,而埋起来恰恰就是问题所在。

答对 · 我记下:这项服务运行起来并不需要这项分析,而这种压力对我同意的自由性是不利的。

在切断服务的威胁下给出的同意,一开始就背着沉重的不利 条例没有说“禁止”:它说的是怎么判断。在评估同意是否自由给出时,必须最大程度地考虑该服务是否以一项其履行并不需要的同意为条件。一个要求对你路线做广告分析的跑步应用,一字一句地符合这段描述,而这正是监管机构将会审查的东西。

误区 · 一家私营服务在自己家里想怎么做就怎么做:他们要切断我,那是他们的权利,我只能接受。

误区:“是私营的,所以就允许” 条例恰恰适用于私营服务,而且它预见到了这一幕:把服务以一项对其履行并非必要的同意为条件,这件事在判断同意是否自由时会以全部的重量算在不利的一边。让步并不能抹掉这种失衡:它把失衡记录了下来。

误区 · 如果他们切断我的访问,我以前的跑步记录也会一起丢:不如接受,以后再说。

误区:“我只是暂时接受,其实不算” 一份被记录下来的同意就是一份正在产生效力的同意,没有人会来问你是不是真心的。面对这个两难,法律给你的不是一个半心半意的“是”:而是一项其自由性会被评估的同意,评估时要最大程度地考虑施加在你身上的压力。留下威胁的证据,不要一声不响地让步。

第 4 号材料 · 撤回,说明书遍寻不见

又一个发现:3 年前你注册时,勾过“与合作方共享我的统计数据”。当时就点了一下。今天你想把它收回来。

说“是”点一下,说“不”要一封说明理由的挂号信。这合法吗?

答对 · 我用进来时的同一条渠道撤回,并引用规则:撤回应当和给出一样容易。

撤回的代价恰好等于同意的代价:零 条例把两个动作对齐:你有权在任何时候撤回你的同意,而撤回同意应当和给出同意一样容易。进来点一下,出去要一封说明理由的挂号信,这不是同一种容易:这是一个收费站。而且,在你给出同意之前,就应当有人把这项权利告知你。

“3. The data subject shall have the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Prior to giving consent, the data subject shall be informed thereof. It shall be as easy to withdraw as to give consent.”

误区 · 撤回是要说明理由的:我给法务部准备两段解释。

误区:“撤回需要一个好理由” 这一款的第一句话用几个词就说完了:在任何时候撤回同意的权利。不要理由,不要审核,不要档案。欧盟官方页面确认了这一点:你联系数据控制者,撤回你的许可,任何时候都可以。其余的都是舞台布景。

“If you previously gave your consent for a company or organisation to use your personal data, you can contact the data controller (the person or body handling your personal data) and withdraw your permission at any time. Once you've withdrawn your permission, the company or organisation can no longer use your personal data.”

误区 · 我的撤回一旦提出,他们 3 年来用我数据做过的一切都追溯地变成不合法。

他们的记录这么说。谁该证明什么,而这份卷宗又走向哪里?

答对 · 我要求他们证明那份同意:动作、日期、所给出的信息。举证责任在他们。

“我方记录显示”不是一种证明 在处理以同意为依据的情形下,数据控制者必须能够证明当事人已经同意。不是宣称:是证明。一份真正的同意会留下可以证明的痕迹,有动作、有日期、有事先的信息告知。一行只写着“已接受”而不写何时、如何、对什么的记录,什么也证明不了。

非官方译文:要证明你说过“是”,得由他们来做,不是由你来证明你什么也没说。去要求那份证明。

误区 · 如果他们声称我接受过,那就该由我来证明相反,可我没法证明一片空白。

误区:“该由我来证明我从没说过是” 条例在同意那一条的第 1 款里就把这个问题定了,而且定在相反的方向:数据控制者应当能够证明当事人已经同意。举证在结构上就落在他们那边,因为只有他们保存着记录。你没有什么要证明的:你有一份证明要去索取。
