This is an official ODERSA website. Here’s how you know

The official domain

The address of this site ends in odersa.org. Every service the association runs sits on a subdomain of odersa.org and nowhere else. If the address in your browser’s address bar does not end in odersa.org, this site is not ours.

Free, and no account

Everything is open straight away. No sign-up, no account, no password, no subscription, no advertising. Nothing is held back for those who pay, because there is nothing to pay for.

No data collected

This site does not follow you: no tracker, no tracking cookie, no measurement tool built into these pages, and nothing measured on your device. Our host counts requests in aggregate, as any server that answers does: a total, never a profile. You do not have to take our word for it: open your browser’s developer tools, go to the Network tab, and reload the page. You will see the full list of what the site asks for. Everything comes from odersa.org, nothing goes anywhere else.

Free to reuse

The content is published under the CC BY 4.0 licence. You may copy it, translate it, print it and pass it on, for your classes as much as for the people around you, on one condition only: credit ODERSA.

Official redress

The real redress, in order

Four steps, to be climbed in this order: each one leaves a written trace that serves the next.

File EU 93/13

General information, not legal advice on your case. Every remedy has a time limit, often set by national rules: act early, and check the limit that applies to your case before you wait.

  1. The trader, in writing, clause cited

As soon as you discover it

Challenge the clause by citing the precise point of the directive's annex it matches, attach the screenshots of the sign-up flow and ask for a written position. Do not stop paying what remains due at the agreed rate: the rest of the contract remains valid.

  2. Your country's consumer association, or the ECC network

If the trader stands by its clause

The official page of the Union names the two desks: national consumer associations for a problem in the country where you live, and the European Consumer Centres Network for a cross-border dispute.

    European Consumer Centres Network (ECC-Net)

  3. Consumer dispute resolution

    If the dispute settles in

If the dispute settles in, the official page of the Union describes the consumer dispute resolution routes, amicable then judicial, and points to the competent bodies in each country.

  4. The European Small Claims Procedure

    Last

For a cross-border claim, the written European procedure exists, and the regulation establishing it states in black and white that representation by a lawyer or another legal professional is not mandatory.

Only a judge or an authority can declare a term unfair: this file teaches spotting and challenging, never deciding. National termination rules, sometimes more protective, are not covered here: this site presents only the European baseline common to the twenty-seven, which a directive sets as a minimum.
